MEDIATION

The process of mediation is simple to explain. When the parties in a dispute agree to mediation, they select a neutral/unbiased person who attempts to facilitate a mutually acceptable settlement agreement.  Mediation is informal and there are no court procedures or rules of evidence and the mediator has no authority to render a decision or force parties to accept a settlement. Mediation is a useful process for all kinds of disputes. The parties involved in mediation maintain the control/"say so" concerning their negotiating position. Successful mediations get cases settled which saves money and time by avoiding litigation.

While the mechanics of mediation are easy to explain, the process can invoke an array of complex financial, legal and emotional dynamics. Selecting a mediator with Joe Durkee's varied litigation, trial and life experience is the first step in pursuing a successful mediated outcome.
