
ARBITRATION
Arbitrations are much less formal than jury or bench trials. Additionally, arbitrations cost less and take much less time than trials. The process of arbitration invokes a neutral third-party (arbitrator) who conducts an evidentiary hearing. The arbitrator rules on pre-hearing disputes, conducts the arbitration, and finally, makes a decision and issues an award. Arbitrations are attended by the parties, their attorneys, the arbitrator, and witnesses. Each party makes an opening statement, presents their evidence, questions and cross examines witnesses, and makes a closing statement. Upon consideration of the evidence, the arbitrator makes a decision. Arbitrations can be binding or non-binding. Parties in an arbitration can customize the proceeding in almost any manner they chose.
